Not All Workers Are Entitled to the Minimum Wage

I don’t know if anyone has been following this at all, but Crabby complained to our state legislators about poll workers being paid less than minimum wage. In my humble opinion poll workers should be paid at least as much as a fry cook at a greasy spoon. It is my opinion that poll workers would be covered by the minimum wage Constitutional amendment that went into effect January 1st of this year. Sen. Tim Shaffer submitted the question to Attorney General Marc Dann.
Today Marc Dann responded in a 15 page opinion that Poll Workers are NOT employees that would be subject to the new constitutional amendment setting the minimum wage. They are, instead, “Volunteers”. They are, of course subject to Federal and State taxes (Lancaster Income Tax exempts this pay) and even PERS for public employees.
